New Legislative Measures to Safeguard Individual Rights Against AI Misuse
The proposed Nurture Originals, Foster Art, and Keep Entertainment Safe (NO FAKES) Act of 2024 was unveiled on Wednesday by U.S. Senators Chris Coons (D-Del.), Marsha Blackburn (R-Tenn.), Amy Klobuchar (D-Minn.), and Thom Tillis (R-NC). This bipartisan effort aims to extend protection to individuals regarding unauthorized AI-generated duplications of their voices and images.
Empowering Individuals with Legal Protections
This groundbreaking legislation seeks to establish a framework for legal action for those who find themselves victims of non-consensual digital representations. It proposes accountability for both individual creators and corporations involved in generating, hosting, or disseminating these unauthorized replicas—including those emerging from generative artificial intelligence technologies. In recent years, advancements in generative AI have simplified the process of fabricating convincing audio or visual fakes, with fully realistic video imitations expected on the horizon.
Advocacy for Ownership Rights in the Age of AI
In his press release, Senator Coons stressed the urgent need to protect personal rights amidst rapid technological growth. He articulated that “Everyone has the right to own and defend their voice and likeness; this applies equally whether you are someone like Taylor Swift or an everyday person.” His remarks echoed concerns raised earlier this year regarding a notable deepfake incident involving Swift. Coons further noted that while generative AI holds potential as an innovative tool for creativity, it should not facilitate unauthorized appropriation or misuse of anyone’s identity.
