The Legal Battle Ignites
Following a public threat made by De Moraes against a legal representative for X in Brazil—warning of potential arrest unless censorship demands were met—the Global Government Affairs division for X took to their platform to disclose this alarming situation. They shared a post detailing these threats along with screenshots displaying the contentious legal order issued by Brazil’s National High Court. According to Reuters, this order imposes severe fines amounting to 20,000 reais (approximately $3,653) if Rachel Nova Conceicao—a liaison for the company—does not comply with directives mandating the removal of certain posts.
Targeting Online Misinformation and Hate Speech
De Moraes specifically aims his sights on “digital militias,” which he accuses of propagating fake news alongside incendiary rhetoric concerning Jair Bolsonaro, who previously held presidency and is known for his far-right policies.
While freedom of speech protections exist within both United States and Brazilian legislation, it’s crucial to note that Brazil permits more latitude regarding restrictions that can be placed on certain types of speech such as hate speech compared to American laws.
A Call for Due Process
X contends that their repeated appeals through proper judicial channels have been largely ignored. The statement from their Global Government Affairs team emphasized the lack of transparency surrounding these directives imposed by De Moraes directed at their staff who are neither accountable nor capable when it comes to restricting content appearing online.
The Standoff Over Content Moderation Continues
Musk’s ongoing tussle with De Moraes began several months ago when requests surfaced demanding specific accounts be banned due to alleged dissemination of misinformation tailored against Brazil’s judiciary during Bolsonaro’s tenure. At one point during negotiations about compliance with court orders from other nations like Turkey—a scenario which had seen prior cooperation—Musk initially acquiesced only later reversing those decisions even amid threats from De Moraes amidst potential penalties reaching into thousands daily per renewed accounts reinstated without justification.
