In light of recent developments, Elon Musk has indicated he may pursue legal action after reports surfaced that a California state commission referenced his political views when denying a request for increased launch frequency by SpaceX along the central coast of California.
On Thursday, the California Coastal Commission voted 6-4 against a proposal from the US Space Force to raise the number of Falcon 9 rocket launches at Vandenberg Space Force Base from 36 to 50 annually.
Concerns Raised During Commission Meeting
A video recording of the meeting, which was reviewed by Business Insider, featured commissioner Gretchen Newsom expressing her apprehensions prior to the vote. She highlighted issues related to Musk’s political statements and working conditions at SpaceX. “Elon Musk is traveling across the country making politically charged statements and criticizing FEMA while claiming he wants to assist hurricane victims with complimentary Starlink internet access,” she remarked. “It seems that rather than focusing on employee welfare and environmental considerations, there is an emphasis on maximizing profits.”
Caryl Hart, chair of the commission, acknowledged Newsom’s comments but noted that while it could be argued politics were being introduced into this matter, it inherently involves governmental interests due to its connection with both federal agencies and local regulations. Hart expressed appreciation for the military’s contributions but emphasized that they were dealing with an individual who has actively engaged in presidential campaigning.
Musk’s Response and Future Actions
Musk responded via X (formerly Twitter) to coverage by Politico regarding these remarks. He stated: “This is incredibly inappropriate. My posts have no relevance to any ‘coastal commission’ in California!” He further announced plans to file suit against them on Monday for what he claims is a violation of First Amendment rights—though he clarified this would occur Tuesday since courts are closed on Mondays.
The Commission’s Stance on Permits
The commission aims to safeguard California’s coastal regions and oceans; thus they disagreed with both SpaceX and military assertions that their operations should be classified as federal agency activities exempting them from needing permits for launching operations. Commissioners contended that as primarily a private entity, it was imperative for SpaceX itself to secure necessary permits before proceeding with additional launches.
“It is crucial that SpaceX applies for a Coastal Development Permit (CDP),” Hart stated firmly. “In my view, there are no alternative paths forward.”
Environmental Considerations Highlighted by Commissioners
Several commissioners took this opportunity not only to express their concerns about potential environmental impacts stemming from rocket sonic booms but also commended recent collaborative efforts between military representatives and staff addressing ecological issues. Dr. Ravi Chaudhary, an assistant secretary within the Air Force hierarchy present at this hearing reaffirmed their commitment towards protecting coastal ecosystems during these discussions.
