Nintendo Takes Legal Action Against Streamer for Piracy Allegations
Nintendo has initiated a lawsuit against a streamer known as EveryGameGuru, accusing him of broadcasting gameplay from pirated games prior to their official release dates. The company claims that the defendant has been providing viewers with access to illegal ROMs and piracy tools while streaming on various platforms such as YouTube, Discord, Twitch, TikTok, Trovo, Kick, Vaughn, Dlive, Picarto, Nimo, Facebook and Loco. Reports indicate that EveryGameGuru has streamed at least ten different titles illegally on over fifty occasions since 2022.
Specific Instances of Alleged Piracy
One notable instance involved the game Mario & Luigi: Brothership, which was streamed by EveryGameGuru on October 22-25 and again on October 29—well ahead of its official launch date of November 7. Following Nintendo’s efforts to remove these videos from multiple platforms including YouTube, he persisted in livestreaming on Loco and even displayed a QR code linked to his CashApp account. Furthermore, he reportedly created new accounts after previous ones were disabled by the platform’s moderators. In an email sent to Nintendo representatives, he boasted about having “a thousand burner channels” and claimed that he could continue this activity indefinitely.
Additional Games Under Scrutiny
Apart from Mario & Luigi: Brothership, Nintendo identified several other titles that EveryGameGuru allegedly streamed before their release dates. These include The Legends of Zelda: Echoes of Wisdom, Paper Mario: The Thousand-Year Door, Mario vs. Donkey Kong, Super Mario RPG, Super Mario Bros. Wonder, Pikmin 4, Splatoon 3, and Mario Strikers: Battle League. Additionally, Nintendo provided evidence in the form of screenshots showing EveryGameGuru linking viewers to piracy tools within his content.
Piracy Tools Promotion Revealed in Screenshots
A particular screenshot highlighted a post where he detailed instructions for playing illegally downloaded ROMs while including links to popular emulators like Ryujinx and Yuzu along with sites distributing game ROMs and decryption keys necessary for accessing Switch games. In this post filled with frustration over his channel being deleted for sharing gameplay videos he exclaimed in all caps: “Capitalism is cancer! This is your reward!”
Pursuing Damages for Copyright Violations
Nintendo is seeking $150,000 per copyright infringement violation in damages through this lawsuit—a figure that could potentially escalate into millions given the number of alleged illegal streams conducted by EveryGameGuru across various titles.
